Marland & Colburt

In the matter of PAC 1068 of 2021, Mr Marland (the applicant) sought orders against Ms Colburt (the respondent). The application initiating these proceedings, filed on 1 March 2021, was dismissed by Foster J of the Federal Circuit Court.

The central legal issue before the court was whether the application should be summarily dismissed. This arose because the application was identical to a previous application that had already been dismissed by the Federal Circuit Court. The court was required to consider the application of Rule 10.12 of the Family Law Rules 2004 (Cth) in these circumstances.

Foster J determined that the application should be struck out and dismissed. The reasoning for this decision was that the applicant had brought an application that was the same as one previously dismissed by the court. This effectively constituted an abuse of process, justifying the summary dismissal under the relevant court rules.

The court ordered that the application initiating proceedings filed by the father on 1 March 2021 be struck out and dismissed.
