The Court distinguished this type of jurisdiction from the act of levying rates, which it described as the exaction of money in respect of a connection with land, involving a charge by way of security but not an exercise of power or control over the land's use or activities. The Court noted that while marine boards might historically be exempt from rates under other legislation, no such exemption was provided for in the *Launceston Corporation Act 1941* (Tas.) in relation to the appellant.

Consequently, the High Court dismissed the appeal, affirming the decision of the Supreme Court of Tasmania. The appellant was ordered to pay the respondent's costs.
