Mangoplah Pastoral Co Pty Ltd v Great Southern Energy

Mangoplah Pastoral Co Pty Ltd sought judicial review of a decision by the Victorian Civil and Administrative Tribunal which dismissed their application for access to documents held by Great Southern Energy. The case was heard by Justice Mortimer of the Supreme Court of Victoria. The applicant sought access to documents relating to the rates it had been charged by the respondent. The applicant argued that the documents were relevant to its case that the rates were excessive and had been set in an unlawful manner. The respondent argued that the documents were confidential and exempt from disclosure under the Freedom of Information Act 1982 (Vic). The court was required to determine whether the documents were exempt from disclosure under the Act and, if not, whether the public interest in disclosure outweighed any harm that might be caused by disclosure. The court found that the documents were not exempt from disclosure and that the public interest in disclosure outweighed any harm that might be caused by disclosure. The court held that the documents contained information relevant to the applicant's case and that the harm caused by disclosure was minimal. The court held that the documents should be disclosed to the applicant, with the exception of one document which was exempt from disclosure.
