Mangini and Secretary, Department of Social Services (Social services second review)

This matter concerned an appeal by Mr Mangini against a decision of the Secretary, Department of Social Services, which determined that Mr Mangini had been paid Newstart Allowance (NSA) in excess of his correct entitlement, resulting in a recoverable debt of $4,454.89. The dispute arose from the receipt of payments under an income protection policy during the period Mr Mangini was receiving NSA. The Administrative Appeals Tribunal (AAT) considered whether the debt was recoverable and whether it should be waived or written off.

Consequently, the Tribunal set aside the decision under review and substituted it with a decision to waive the recovery of Mr Mangini's NSA debt in the amount of $4,454.89.
