CaseChat Overview and Summary

This matter concerned orders made by Justice Rose in the Federal Circuit and Family Court of Australia concerning the division of property between a husband and wife. The dispute centred on the sale of the former matrimonial home and the distribution of its proceeds, as well as the allocation of various other assets and liabilities between the parties.

The court was required to determine the terms of the sale of the former matrimonial home, including the method of sale, reserve price, and the distribution of sale proceeds. Further issues included the discharge of mortgages, the application of specific loan amounts by the wife, the payment of periodic amounts by the husband, and the transfer of various company shares, property interests, and partnership interests between the parties. The court also had to address the husband's indemnification of the wife against liabilities arising from her directorships, trusteeships, and partnership interests, and the transfer of a motor vehicle. Finally, the court needed to define the parties' respective beneficial interests in remaining assets and personalty.

Justice Rose ordered that the parties forthwith sign all necessary documents for the sale of the former matrimonial home by public auction, unless otherwise agreed. The proceeds were to be applied first to sale expenses, then legal costs, with 91.27% of the balance to the wife and the remainder to the husband. The husband was to arrange for the discharge of any mortgages on the property. Upon receiving her share, the wife was to apply it to specific loan accounts totalling $185,305.00, plus any further liabilities incurred under previous consent orders. The husband was to continue paying periodic amounts as per interim orders until the sale completion. Upon the husband complying with these orders, the wife was to resign as director and transfer her shareholdings in several companies to the husband, along with her interests in specified properties and the Mancini Partnership. The husband was to indemnify the wife against all liabilities arising from her involvement with these companies, the Family Unit Trust, and the Mancini Partnership. Within twenty-eight days, the husband was to transfer a Porsche motor vehicle to the wife free of encumbrance. Upon full compliance by the husband, he would receive the beneficial interest in various assets including a runabout boat, a boat named "[S]", timeshares, properties in Queensland and Mexico, his interest in the Family Superannuation Fund, the Family Trust, and the Family Unit Trust. Conversely, the wife would receive the beneficial interest in the contents of the former matrimonial home and other personalty valued at $38,151.00. Each party was to retain other property in their possession or name, except as otherwise ordered. The Registrar was appointed to execute documents if a party failed to do so within seven days of request. Liberty to apply was granted on seven days' written notice.
