CaseChat Overview and Summary

In Mammoth Investments Pty Ltd v Donaldson, the Court of Appeal of Western Australia considered two questions of statutory interpretation in relation to the Legal Profession Act 2008 (WA). The first question was whether a lay client was entitled to apply to a taxing officer for an assessment of legal costs and to request an itemised bill where a costs agreement was entered into between a solicitor and a barrister. The second question was whether certain invoices issued by the barrister satisfied the definition of 'itemised bill'. The Court of Appeal found in favour of the appellants on both questions. The Court held that the definition of 'client' permitted the lay client to apply for an assessment of legal costs and to request an itemised bill, notwithstanding the existence of a costs agreement between the solicitor and the barrister. The Court also held that the invoices did not specify in detail how the legal costs were made up in a way that would allow them to be assessed, and were therefore not itemised bills. The Court set aside the primary court's orders and made orders in substance to the effect sought by the appellants, requiring the respondent to provide itemised bills for the four invoices in question. The Court granted the appellants a short extension of the time to appeal and ordered that the costs of the appeal and of the primary proceedings be heard from the parties.
