MAIER & MAIER

In *Maier & Maier*, heard by Judge Middleton, the proceedings concerned allegations made by the Mother regarding the Father's character and the involvement of extended paternal family members in the sexual abuse of the children. The case also noted the children's non-disclosure of abuse at previous interviews, a subsequent alleged disclosure following Family Report interviews, and an ongoing Joint Investigation Response Team (JIRT) enquiry.

The court was required to determine the appropriate course of action in light of these serious allegations, particularly concerning the welfare and representation of the children. The court also considered the release of certain subpoenas for inspection by the parties and their legal representatives.

Judge Middleton ordered that subpoenas 18, 28, 29, and 30 be released for inspection. Crucially, the proceedings were transferred to the Family Court of Australia in Newcastle pursuant to Rule 8.02 of the Federal Circuit Court Rules. The court further ordered that the children be separately represented, requesting the Legal Aid Commission New South Wales to arrange this. Both parties were directed to provide the Legal Aid Commission with copies of all relevant orders, reports, applications, and affidavits forthwith. The Applicant Father's costs of the day were reserved, and a transcript of the reasons for judgment was to be provided and placed on the file.
