Magolan and Caffery

The matter of *Magolan and Caffery* came before Judge Young. The dispute concerned allegations of sexual abuse of a child by the father. While these allegations were investigated and not substantiated, Territory Families recommended that the child's time with the father be supervised indefinitely.

The central legal issue before the court was the appropriate forum for determining the child's welfare and the arrangements for contact with the father, given the unresolved concerns raised by Territory Families.

Judge Young determined that the Family Court of Australia was the most appropriate jurisdiction to hear and determine the matter. Consequently, the court ordered that the proceedings be transferred to the Family Court of Australia and listed for hearing in the Darwin Circuit at a date to be advised to the parties.
