Magarditch and Anor v ANZ Banking Group

The applicants, Magarditch and Anor, sought to restrain ANZ Banking Group from exercising its rights under a mortgage. The dispute concerned the validity of the mortgage and the circumstances under which it was entered into. The matter came before Gaudron J in chambers.

Gaudron J considered the principles of undue influence and misrepresentation in contract law. Her Honour found that the applicants had not established that they were subject to undue influence or that any misrepresentations had been made by the bank. The evidence did not support the claim that the applicants lacked the capacity to understand the documents or that they were improperly pressured into signing them.

The application to restrain the bank was dismissed.
