CaseChat Overview and Summary
The primary legal issue before the Commission was whether the enterprise agreement provided for the proper bargaining of employees' terms and conditions of employment. Specifically, the applicant needed to demonstrate that the agreement was made in good faith and that it complied with the procedural and substantive requirements outlined in the Fair Work Act. The Commission needed to assess whether the agreement was genuinely negotiated between the employer and the employees' representatives, and whether it met the criteria for being a simple, fair, and efficient workplace agreement.
The Fair Work Commission found that the enterprise agreement was indeed made in good faith and satisfied the necessary requirements for approval. The Commission acknowledged that the agreement had been negotiated between the employer and the employees' representatives, and that it provided for fair and reasonable terms and conditions of employment. The Commission determined that the agreement was simple, fair, and efficient, and that it met all the criteria for approval under the Fair Work Act. Accordingly, the Commission approved the Metalform Structures P/L Enterprise Agreement 2017.
