Judgment
-
COMMISSIONER: This an appeal against the refusal of DA No: 2012/217 by Bega Valley Shire Council for the construction of an educational establishment at Lots 112, 113 and 115 Kulbardi Close, Bournda.
-
In this matter, at or after a conciliation conference, an agreement under s 34(3) of the Land and Environment Court Act 1979 (the Court Act) was reached between the parties as to the terms of a decision in the proceedings that was acceptable to the parties. As the presiding Commissioner, I was satisfied that the decision was one that the Court could have made in the proper exercise of its functions (this being the test applied by s 34(3) of the Court Act). As a consequence, s 34(3)(a) of the Act required me to “dispose of the proceedings in accordance with the decision”.
-
The Court Act also required me to “set out in writing the terms of the decision” (s 34(3)(b)). The orders made to give effect to the agreement constitute that document.
-
In making the orders to give effect to the agreement between the parties, I was not required to, and have not, made any merit assessment of the issues that were originally in dispute between the parties.
-
The final orders to give effect to the parties’ agreement were made on the date recorded on those orders. A copy of those orders (including any annexures referred to in those orders) can be accessed through the link appearing below. The date of the orders appears on the first page of the orders.

CaseChat Overview and Summary
The central legal issues before the court were whether the Council owed a duty of care to Mr Lyons as a member of the public using the footpath, and if so, whether it had breached that duty by failing to maintain the footpath in a safe condition. The court had to determine whether the Council's actions constituted negligence and if Mr Lyons's injuries were a direct result of that negligence. Additionally, the court needed to assess the extent of the Council's liability, if any, for the damages claimed by Mr Lyons.
In its judgment, the court found that the Council did owe a duty of care to the public, including Mr Lyons, to maintain the footpath in a reasonably safe condition. The court concluded that the Council had indeed breached this duty, as the footpath was uneven and had a significant defect that posed a foreseeable risk of injury. The court held that the Council's failure to address the defect, despite being aware of it, constituted negligence. Consequently, the Council was held liable for Mr Lyons's injuries, and the court awarded damages to compensate for his losses.
The court ordered the Bega Valley Shire Council to pay Mr Lyons a sum of money as compensation for his injuries, covering medical expenses, loss of income, and pain and suffering. The court also directed that the Council take steps to rectify the defect on the footpath to prevent future accidents.
