CaseChat Overview and Summary

The plaintiff, Lye, brought an action against the State of New South Wales for malicious prosecution. The primary judge had found that the prosecution was without reasonable and probable cause, but was not satisfied that the prosecution was for an improper purpose, either to pressure the plaintiff to cooperate in the investigation of other matters or for any other improper purpose. The plaintiff appealed this finding to the Court of Appeal of New South Wales.

The central legal issue before the Court of Appeal was whether the primary judge erred in finding that the prosecution was not actuated by an improper purpose, despite acknowledging the absence of reasonable and probable cause. The plaintiff contended that the primary judge should have concluded that the prosecution was initiated for an improper purpose, or that the prosecution was undertaken with the ulterior motive of coercing her cooperation in unrelated investigations.

The Court of Appeal, comprising Giles, Tobias and Bryson JJA, considered the evidence and the primary judge's findings. The court held that the plaintiff had failed to demonstrate that the primary judge had made an error in his assessment of the evidence regarding the purpose of the prosecution. The court found no basis to interfere with the primary judge's conclusion that the prosecution was not proven to be for an improper purpose.

Consequently, the Court of Appeal dismissed the appeal. Leave to appeal and an extension of time for filing the notice of appeal were granted nunc pro tunc. The appellant was ordered to pay the respondent's costs of the appeal, including the costs associated with specific notices of motion.
