The principles of procedural fairness, as established in Australian administrative law, mandate that a person affected by a decision must be given a fair hearing, which includes being aware of and able to controvert adverse material relied upon by the decision-maker.

The High Court allowed the appeal, set aside the orders of the Federal Court of Australia, and remitted the matter to the Federal Court for determination of the appropriate relief.
