LOVE & LUNDY

In the matter of *Love & Lundy*, heard by Judge Harland, the applicant, Ms Love, sought a declaration of parentage under section 60H of the *Family Law Act 1975* (Cth) concerning a child, X, born in 2011. The respondent, Mr Lundy, was the other party to the proceedings.

The primary legal issue before the Court was whether Ms Love should be declared a parent of X for the purposes of the *Family Law Act*. Ancillary to this, the Court was required to determine issues of parental responsibility, the child's residence, and the applicant's time with the child.

Judge Harland reasoned that Ms Love met the criteria for parentage under section 60H of the *Family Law Act*. Applying the principles established in relevant case law concerning parentage, the Court made a declaration that Ms Love is a parent of X. Consequently, the Court ordered that the respondent have sole parental responsibility for the child, that X live with the respondent, and that Ms Love spend time with X as agreed between the parties. All previous orders were discharged.
