Application for approval of the Loddon Campaspe Centre Against Sexual Assault (LCCASA) Agreement 2015 - 2018.
[1] An application has been made for approval of an enterprise agreement known as the Loddon Campaspe Centre Against Sexual Assault (LCCASA) Agreement 2015 - 2018 (the Agreement). The application was made pursuant to s.185 of the Fair Work Act 2009 (the Act). It has been made by Loddon Campaspe Centre Against Sexual Assault (LCCASA) T/A Centre Against Sexual Assault Loddon Campaspe Region. The agreement is a single-enterprise agreement.
[2] An undertaking has been given to adopt the model consultation clause and is taken to be a term of the Agreement. A copy of the undertaking is attached to this Decision as Annexure A and can also be found at the end of the Agreement.
[3] Subject to the undertaking referred to above, I am satisfied that each of the requirements of ss.186, 187 and 188 as are relevant to this application for approval have been met.
[4] The agreement does not contain a consultation provision in the terms of s.205 of the Act. Pursuant to s.205(2) of the Act, the model consultation term prescribed by the Fair Work Regulations 2009 is taken to be a term of the Agreement, and will be appended to the Agreement.
[5] The Agreement was approved in Chambers on 20 October 2015 and, in accordance with s.54 of the Act, will operate from 27 October 2015. The nominal expiry date of the Agreement is 30 August 2018.
