Liu (Migration)

The Administrative Appeals Tribunal considered the application of Ms Liu for a Temporary Skill Shortage (Class GK) visa, Subclass 482, short-term stream. The core of the dispute revolved around the nominated position of Retail Buyer (ANZSCO Code: 639211) and whether the applicant had an approved standard business sponsor for this role. The applicant had provided evidence of health insurance, a Bridging Visa B, and details of her employment as a Merchandise Planner, including a comprehensive list of her duties and responsibilities.

The Tribunal was required to determine whether the applicant met the criteria for the nominated position, specifically in relation to the employer's sponsorship status. The applicant's resume detailed extensive experience in merchandising and planning, including tasks such as summarizing sales and stock data, researching international manufacturers, negotiating with suppliers, preparing forecasts and budgets, and managing merchandise allocation. These duties were presented to demonstrate the applicant's suitability for the nominated role.

The Tribunal found that the matter should be remitted for reconsideration by the Minister. It directed that the applicant met specific criteria for the Subclass 482 visa, namely those outlined in cl 482.212 and cl 482.312 of Schedule 2 to the Regulations. This indicates that while certain aspects of the application were satisfied, further consideration was necessary regarding other criteria for the visa.
