The application was made pursuant to s.185 of the Fair Work Act 2009 (the Act). It has been made by Linfox Australia Pty Ltd (the Applicant). The agreement is a single-enterprise agreement.

CaseChat Overview and Summary
The central legal issue before the Commission was whether the agreement provided for terms and conditions that were, at a minimum, no worse off than those provided by the relevant award. This required the Commission to assess the provisions of the agreement against the National Employment Standards and the relevant award to ensure that the employees' entitlements were not diminished. The Commission also had to consider whether the agreement was made in good faith and whether it was genuinely an agreement between the employer and the employees.
The Fair Work Commission found that the agreement provided for terms and conditions that were no worse off than those provided by the relevant award. The Commission noted that the agreement contained provisions that were consistent with the National Employment Standards and provided for reasonable working conditions. The Commission was satisfied that the agreement was made in good faith and that it represented a genuine agreement between the employer and the employees. The Commission approved the agreement, stating that it met the requirements of the Fair Work Act 2009.
