The Family Court of Australia, presided over by Gill J, considered a dispute between a mother and father concerning the living arrangements and time spent with their three children, X, Y, and Z. The core of the disagreement revolved around schooling and the division of parental time during school terms and holidays.

The court was required to determine the primary residence of the children, which school they would attend, and the specific arrangements for time spent with each parent during term and holiday periods. This included decisions regarding boarding arrangements for one child and the allocation of holidays between the parents.

Gill J ordered that the children Z and Y would live with the mother and be enrolled at G School. Child X, also born in 2005, was to live with the mother during the week and attend F School as a boarder, with specific provisions for time spent with both parents should X be absent from school during a week. The court also established a detailed schedule for X's time with each parent during term and holidays, which was mirrored for Z and Y's time with the father. Changeovers were to occur at H Park.
