The legal issues before the Commission centred on whether the agreement met the statutory requirements under the Fair Work Act 2009. Specifically, the Commission had to determine if the agreement was made in good faith and if it provided for the terms and conditions of employment of the employees in a fair and reasonable manner. The Commission also considered if the agreement contained all the mandatory terms as required by the Act and if it complied with the procedural requirements for registration.
