Legal Profession Conduct Commissioner v Kassapis

The Legal Profession Conduct Commissioner applied to the Supreme Court of South Australia to strike the name of John-Paul Kassapis from the Roll of Legal Practitioners. The application concerned allegations of unprofessional conduct by Mr Kassapis during his practice as a solicitor, which he largely admitted. The court comprised Gray, Sulan, and Nicholson JJ.

The primary legal issue before the court was whether Mr Kassapis's conduct amounted to professional misconduct of such a serious nature that his name should be removed from the Roll of Legal Practitioners. The court found that Mr Kassapis had engaged in unprofessional conduct, including failing to account for trust monies, failing to provide proper accounts and receipts to clients, providing false statements to a client, lying to the Legal Practitioners Conduct Board, and misleading the court by preparing a false affidavit. While medical evidence indicated that Mr Kassapis suffered from a chronic adjustment disorder with anxiety and depression, combined with a personality disorder, which diminished his ability to control his behaviour, the court noted he was not mentally incompetent and could take responsibility for his actions. The court also considered his limited engagement with treatment and his difficulty in accepting responsibility for his errors. Ultimately, the court concluded that the seriousness and breadth of his misconduct, which materially disadvantaged clients and hindered investigations, warranted his removal from the Roll to maintain public confidence in the legal profession.

The court ordered that the name of John-Paul Kassapis be struck off the Roll of Legal Practitioners.
