This matter concerned an application for a Student (Temporary) (Class TU) visa, Subclass 500, brought before the Administrative Appeals Tribunal. The dispute centred on whether the secondary applicant, Kuan Xin Wong, qualified as a member of the family unit of the primary applicant, a prerequisite for satisfying certain visa criteria.

The Tribunal was required to determine if the secondary applicant met the criteria for a Subclass 500 visa, specifically in relation to being a member of the family unit. This involved assessing whether the primary applicant met the relevant visa requirements, which would then impact the eligibility of the secondary applicant.

The Tribunal found that the secondary applicant, Kuan Xin Wong, was indeed a member of the family unit of the primary applicant. Consequently, as the primary applicant was found to satisfy clause 500.211 of Schedule 2 to the Regulations, it followed that the secondary applicant satisfied clause 500.311. The Tribunal therefore remitted the applications for reconsideration with a direction that both the first and second named applicants meet the specified criteria for the visa.
