In the matter of LAWS & LAWS, Tree J of the Federal Circuit Court of Australia considered an application by Ms Laws (the Applicant) concerning property division and related matters. The dispute involved the sale of a property registered in the name of Mr Laws (the Husband) and the distribution of the proceeds, as well as the suspension of a prior court order.

The court was required to determine the appropriate orders for the vesting and sale of the property at B Street, C Town, and the disbursement of the sale proceeds. Key issues included the allocation of funds to discharge a mortgage and statutory charges, and the division of the net proceeds between the Husband and Wife. The court also had to consider the suspension of a previous order made by Judge Coker.

Tree J ordered that the property be vested in Ms Laws as Trustee for sale. The proceeds of sale were to be applied first to cover sale costs, the discharge of the Westpac Banking Corporation mortgage, and any statutory charges. The remaining net proceeds were to be divided equally, with 50 per cent to be held in trust pending further agreement or court order, and the other 50 per cent to be retained by the Wife, with its characterisation to be determined later. The court also ordered the enlargement of the return date for a subpoena issued to the Husband's father and suspended a prior order of Judge Coker pursuant to s 83(1)(d) of the Family Law Act 1975.
