CaseChat Overview and Summary
The legal issues before the Commission were whether the agreement provided for fair and reasonable terms and conditions of employment and whether it complied with the requirements of the Fair Work Act 2009. Specifically, the Commission had to determine if the agreement met the 'better off overall test' and whether it contained provisions that were contrary to public policy or contrary to the principles of the Fair Work Act.
The Fair Work Commission found that the Laminex Ballarat Componentry Plant Agreement 2025 provided for fair and reasonable terms and conditions of employment. The Commission noted that the agreement included provisions that were better off overall for the employees compared to the existing awards. Additionally, the Commission was satisfied that the agreement did not contain any provisions that were contrary to public policy or the principles of the Fair Work Act. Consequently, the Commission approved the agreement.
The Fair Work Commission issued an order approving the Laminex Ballarat Componentry Plant Agreement 2025, effective from the date of the order. The agreement was set to govern the employment of workers at the Laminex Ballarat Componentry Plant and would remain in force until it was terminated or varied by a future agreement.
