Lambton and Lambton

This case concerned parenting arrangements and property division between Ms Lambton (the mother) and Mr Lambton (the father) concerning their child, B. The matter came before Rees J.

The court was required to determine orders regarding the child's living arrangements, time spent with each parent, and overseas travel. Additionally, the court needed to make orders concerning the division of the husband's Company D Deferred Shares, a lump sum payment to the wife, superannuation entitlements, and spousal maintenance.

Rees J made orders for equal shared parental responsibility, with the child to live with the mother. Specific time arrangements were set out for the father, including regular weekday and weekend time, and a division of school holidays. Provisions were made for overseas travel by both parents, with notice requirements and cost-sharing for airfares. The court also ordered the husband to sell 60% of his vested Company D Deferred Shares, with proceeds to be distributed after sale costs, with a portion paid to a joint account for tax liabilities and the balance to the wife. The husband was ordered to pay a lump sum of $656,288 to the wife within three months, with provisions for sale of property and interest if payment was delayed. The wife was also entitled to a specific sum from the husband's superannuation. Finally, the husband was ordered to pay spousal maintenance of $1,361 per week for three months or until the lump sum payment was made, whichever was later.
