Lam v MIBP

The applicant, Lam, sought judicial review of a decision made by the Minister for Immigration, Citizenship, Migrant Services and Multicultural Affairs (the Minister) to refuse to grant a protection visa. The Administrative Appeals Tribunal (AAT) had affirmed the Minister's decision. The matter came before Judge Driver of the Federal Circuit and Family Court of Australia.

The primary legal issue before the Court was whether the Tribunal had erred in law by failing to adequately consider or give sufficient weight to the applicant's claims of past persecution and well-founded fears of future persecution, particularly in relation to the applicant's alleged membership of a particular social group. The applicant contended that the Tribunal's findings were not supported by the evidence before it and that the Tribunal had misunderstood or misapplied the relevant legal tests for assessing claims of persecution.

Judge Driver found that the Tribunal had indeed erred in law. The Court held that the Tribunal had failed to properly engage with the evidence presented by the applicant regarding the specific nature of the persecution he claimed to have suffered and the reasons for his fear of returning to his country of origin. The Court emphasised that a proper assessment of a protection visa claim requires a detailed and nuanced consideration of the applicant's individual circumstances and the specific risks they face, rather than a generalised approach. The Court concluded that the Tribunal's decision was vitiated by a failure to adequately reason its findings in relation to the applicant's claims.

The Court ordered that the decision of the Administrative Appeals Tribunal be set aside and remitted to the Tribunal for redetermination according to law.
