The search had occurred nine months after the applicant ceased working at the location in question, and no other official action had been taken.

Consequently, the Tribunal remitted the application for reconsideration with a direction that the applicant meets PIC 4020 for the purposes of clause 190.216 of Schedule 2 to the Migration Regulations 1994.
