Lagarno and Lagarno

In *Lagarno and Lagarno*, Fowler J determined the property settlement orders between the husband and wife. The dispute concerned the division of various assets, including real property, motor vehicles, personalty, and proceeds from litigation.

The court was required to determine how the parties' respective interests in their jointly and severally held property should be divided. This involved the transfer of a property, the discharge of a mortgage, a cash payment, the valuation and division of specific personalty, the distribution of litigation proceeds, and the declaration of ownership for remaining assets in each party's possession.

Fowler J ordered the husband to transfer his interest in a property to the wife and to discharge any mortgage on it. The husband was also ordered to pay the wife a sum of $105,000. The court established a process for valuing certain personalty, including a motor vehicle and car parts, requiring the husband to pay the wife 25% of the determined value. Specific items of personal property were to be made available for the wife's collection. Furthermore, the husband was ordered to pay the wife 25% of the net proceeds from ongoing Supreme Court proceedings. The wife was declared the owner of all property in her possession, including a prior partial settlement payment and specified vehicles, while the husband was declared the owner of all remaining property in his possession.
