DEPUTY PRESIDENT MCCARTHY

PERTH, 19 FEBRUARY 2014

Application for approval of the L.S.G Services Pty Ltd Roy Hill AWU Greenfields Agreement 2014.

[1] An application has been made for approval of an enterprise agreement known as the L.S.G. Services Pty Ltd Roy Hill AWU Greenfields Agreement 2014 (the Agreement). The application was made pursuant to s.185 of the Fair Work Act 2009 (the Act).

[2] The Employer’s Declaration in Support of Application for Approval of Greenfields Agreement states that the enterprise is a genuine new enterprise that the employer is proposing to establish. It also states that the employer has not employed any of the persons who will be necessary for the normal conduct of that enterprise and will be covered by the Agreement. I am therefore satisfied that the requirements of s.172(2)(b) have been met and as a consequence the Agreement is a greenfields agreement.

[3] I am satisfied that each of the requirements of ss.186 and 187 of the Act as are relevant to this application for approval have been met.

[4] The Agreement is approved and, in accordance with s.54 of the Act, will operate from seven days from the date of this decision. The nominal expiry date of the Agreement is three and a half years from the date of this decision.

CaseChat Overview and Summary

In the case of L.S.G Services Pty Ltd, the Fair Work Commission was tasked with approving the Roy Hill AWU Greenfields Agreement 2014. The dispute arose as L.S.G Services Pty Ltd sought to establish a new enterprise agreement with the Australian Workers' Union (AWU) to govern employment conditions for workers at the Roy Hill project in Western Australia. The agreement's approval was crucial for the smooth operation of the project, as it would dictate the terms of employment, including wages, hours, and other conditions.

The primary legal issues before the Commission were whether the agreement met the statutory requirements for approval and whether it was consistent with the Fair Work Act 2009. Specifically, the Commission had to consider if the agreement provided for fair and reasonable terms and conditions, if it had been negotiated in good faith, and if it complied with the provisions of the Act. Furthermore, the Commission needed to assess whether the agreement met the "better off overall test" (BOOT) and if it complied with the "no disadvantage test" (NDT), ensuring that employees were not worse off than under the previous agreement.

The Commission reviewed the evidence and submissions from both parties, examining the negotiation process, the terms of the agreement, and the impact on the employees. It found that the agreement had been negotiated in good faith and contained terms and conditions that were fair and reasonable. The Commission also determined that the agreement met the BOOT and NDT, as it did not leave employees worse off and provided for improvements in some areas. Consequently, the Commission approved the Roy Hill AWU Greenfields Agreement 2014, finding that it met all the necessary legal criteria.

The Fair Work Commission's approval of the Roy Hill AWU Greenfields Agreement 2014 was based on the conclusion that the agreement was fair, reasonable, and in compliance with the Fair Work Act 2009. The Commission's decision provided certainty for the parties involved and facilitated the continuation of the Roy Hill project under the new agreement. The approval signified that the agreement met the statutory requirements and was beneficial for both employers and employees.
