The application was brought before the Fair Work Commission, which is tasked with overseeing and approving enterprise agreements in Australia. The dispute centred on whether the agreement met the legal requirements set forth by the Fair Work Act 2009.

The legal issues before the Commission involved determining whether the agreement contained all the mandatory terms required by the Fair Work Act and whether it had been made in good faith and without coercion.
