Kyte and Yorke

In the matter of *Kyte and Yorke*, Rees J considered applications concerning the sale of a property and the husband's appeal against prior orders. The dispute centred on the management and distribution of proceeds from the sale of a property located at G Street, H Town, and the husband's ongoing appeal against orders made on 18 March 2016.

The court was required to determine whether to stay the execution of the 18 March 2016 orders pending the husband's appeal. Additionally, the court needed to decide how the net proceeds of the property sale should be managed and secured, and to provide directions regarding the prosecution of the husband's appeal and the wife's applications for enforcement and costs.

Rees J ordered that the execution of the 18 March 2016 orders be stayed pending the determination of the husband's appeal. The net proceeds from the sale of the G Street property were to be held in a controlled monies account, jointly managed by the solicitors for both parties, after the deduction of specified sale-related expenses and the mortgage repayment. The husband was directed to diligently prosecute his appeal, including compliance with all directions. Finally, the wife's applications for enforcement of the prior orders and for costs were to be listed before the docket registrar for directions.
