The Tribunal concluded that the applicant's circumstances were not sufficiently special to warrant the exercise of discretion to waive the debt under section 1237AAD of the relevant Act. Consequently, the Tribunal set aside the decision under review and substituted it with a decision that the correct amount of debt to be recovered from the applicant was $42,454.13, covering the period from 2 April 2011 to 19 June 2015. This debt comprised Austudy and Clean Energy Supplement debts, an Income Support Bonus debt, and two Student Start-Up Scholarship debts.
