This matter concerned an application for review of a decision by the Secretary, Department of Social Services, to recover a compensation charge from the Applicant. The Tribunal noted that the Deed of Release for the settlement explicitly stated the Applicant was informed of potential liability to pay amounts under various legislative provisions, including the Act, and that the insurer was entitled to deduct such sums. The Tribunal found that the Applicant's circumstances did not constitute "special circumstances" as contemplated by section 1237AAD of the relevant Act, which it considered to have a meaning analogous to section 1184K of the Act. Consequently, the Tribunal affirmed the reviewable decision.
