Kular (Migration)

The Administrative Appeals Tribunal (AAT) reviewed a decision by the Minister for Immigration, Citizenship, Migrant Services and Multicultural Affairs concerning Mr. Kular's application for a Contributory Parent (Class CA) visa (Subclass 143). The core of the dispute revolved around the adequacy of the Assurance of Support provided in support of Mr. Kular's visa application.

The primary legal issue before the AAT was whether the Assurance of Support, as provided, met the requirements of the *Migration Regulations 1994* (Cth) and associated policy guidelines. Specifically, the Tribunal had to determine if the document submitted was a valid and sufficient copy of an Assurance of Support that would satisfy the sponsorship obligations required for the visa subclass.

The AAT found that the document presented as an Assurance of Support was not a complete or satisfactory copy as required by the regulations. The Tribunal reasoned that the absence of certain critical information or the incomplete nature of the provided document meant it could not fulfil the evidentiary requirements for a valid Assurance of Support. Consequently, the AAT remitted the decision to the Minister for reconsideration, directing that further steps be taken to address the deficiency in the Assurance of Support.
