Koseler and National Disability Insurance Agency

The Administrative Appeals Tribunal (AAT) considered an application by Koseler for review of a decision made by the National Disability Insurance Agency (NDIA). Koseler failed to appear at a scheduled directions hearing.

Member L Proske found that the NDIA had provided appropriate notice of the directions hearing to Koseler, satisfying the requirements of section 42A(7). Consequently, the Tribunal was satisfied that it had the power to dismiss the application under section 42A(2). The application for review was therefore dismissed.
