CaseChat Overview and Summary
The primary legal issue before the Commission was whether the agreement contained all the required terms as specified in the Fair Work Act 2009. The Electrical Trades Union of Australia contended that the agreement did not include all the mandated terms, particularly in relation to minimum wages and conditions. The Commission needed to carefully examine the agreement against the statutory requirements to decide if it was compliant. The Commission also considered whether the agreement was made in the course of genuine negotiations between the parties, as required by the Act.
After reviewing the evidence and the agreement, the Commission found that the agreement met all the necessary statutory requirements. It contained all the required terms and was made in the course of genuine negotiations. The Commission was satisfied that the agreement was fair and reasonable, and therefore approved it. The Electrical Trades Union of Australia's objections were dismissed.
The Fair Work Commission approved the KORR Electrical Pty Ltd & CEPU Electrical Division Queensland Enterprise Agreement 2012 - 2015.
