CaseChat Overview and Summary
The legal issues before the Commission included whether the enterprise agreement complied with the Fair Work Act 2009, specifically in terms of ensuring the agreement did not harm employees, and whether it met the procedural requirements for approval. Additionally, the Commission had to consider whether the agreement appropriately balanced the interests of both the employer and employees.
The Commission found that the enterprise agreement was procedurally sound and had been negotiated in good faith. While some provisions raised concerns about fairness, the overall agreement was deemed to meet the statutory standards for approval. The Commission determined that the benefits of the agreement to both parties outweighed the concerns raised by the respondents. Consequently, the Commission approved the enterprise agreement, highlighting the importance of such agreements in providing a stable and fair working environment.
The final order was that the Koppers Wood Products, Longford and CFMEU Enterprise Agreement 2017 be approved as a registered agreement under the Fair Work Act 2009.
