Komi (Migration)

The Administrative Appeals Tribunal considered an application for a Partner (Provisional) (Class UF) visa, subclass 309. The applicants, a couple who viewed their relationship as long-term, sought review of a decision concerning their visa application.

The Tribunal was required to determine whether the applicants were in a genuine and continuing spousal relationship, and whether their marriage was valid for the purposes of the *Migration Act 1958* (Cth) and its associated Regulations.

The Tribunal found that the applicants were validly married and were currently in a genuine spousal relationship, supported by evidence of their long-term commitment. Consequently, the Tribunal remitted the application for the visa to the Minister for reconsideration, with a direction that the visa applicant met the criteria specified in cl.309.211 and cl.309.221 of Schedule 2 to the Regulations.
