CaseChat Overview and Summary
The Commission considered whether the agreement complied with the procedural requirements for the making of an enterprise agreement. It assessed whether the agreement had been made in accordance with the procedures set out in the Fair Work Act and whether the requisite majority of employees had agreed to the terms. The Commission also examined the substantive fairness of the agreement's terms, focusing on whether they provided for appropriate protections and entitlements for employees. The Commission considered whether the agreement provided for a minimum rate of pay and other conditions that were at least equal to or better than the applicable award or registered agreement.
The FWC found that the agreement met all procedural and substantive requirements for approval. The Commission determined that the agreement had been made in accordance with the relevant provisions of the Fair Work Act and that a sufficient majority of employees had agreed to the terms. The Commission was satisfied that the agreement contained terms and conditions that were fair and reasonable, providing for appropriate protections and entitlements for employees. The Commission noted that the agreement provided for a minimum rate of pay and other conditions that were at least equal to or better than the applicable award or registered agreement.
The Fair Work Commission approved the Komatsu Australia Pty Ltd Northern Territory Operations Enterprise Agreement 2021, effective from 1 January 2022. The agreement was registered with the Fair Work Commission, and the relevant parties were notified of the decision.
