Klinavicius (Migration)

The Federal Circuit and Family Court of Australia considered an appeal by Mr. Klinavicius against a decision of the Minister for Immigration, Citizenship, Migrant Services and Multicultural Affairs. The dispute concerned Mr. Klinavicius's application for a Student (Temporary) (Class TU) Subclass 500 visa, specifically whether he met the genuine temporary entrant requirement.

The primary legal issue before the Court was whether the delegate's decision to refuse the visa application was affected by an error of law. This required the Court to assess whether the delegate had properly considered the evidence presented by Mr. Klinavicius regarding his intentions and circumstances, and whether the delegate's conclusion that he was not a genuine temporary entrant was reasonably open on the material before them.

The Court found that the delegate had failed to adequately consider the evidence of Mr. Klinavicius's significant ties to his home country of Lithuania. The delegate's assessment that Mr. Klinavicius was not a credible and truthful witness, and therefore not a genuine temporary entrant, was not sufficiently supported by the material. The Court determined that the evidence presented, including the applicant's personal circumstances and stated intentions, was persuasive and indicated he was a genuine temporary entrant. Consequently, the Court remitted the decision to the Minister for reconsideration.
