CaseChat Overview and Summary

In the matter of *Kinsley and Kinsley*, heard before Judge Altobelli, the proceedings concerned the parental responsibility and living arrangements for two children, X and Y. The dispute centred on the appropriate orders to be made regarding the children's care, contact with the non-resident parent, and the exchange of information between the parents.

The court was required to determine the extent of parental responsibility each parent should hold, where the children should live, and the nature and frequency of contact the Father would have with the children. Further issues included the supervision of contact, the payment of associated costs, the provision of information about the children's welfare and schooling, and the process for making major long-term decisions. The court also had to consider orders restraining denigration of a parent and limiting direct contact between the Father and the Mother and children.

Judge Altobelli ordered that the Mother have sole parental responsibility for the children, and that the children live with the Mother. The Father was granted supervised time with the children on four occasions annually, to be supervised at a contact centre, with the Father responsible for all associated fees. The Mother was ordered to provide specific information regarding the children's health, schooling, and behaviour to the Father twice yearly, and to notify him of any major long-term decisions. Both parents were restrained from denigrating each other in the children's presence, and the Father was restrained from contacting the Mother and children except as permitted by the orders or agreed in writing by the Mother. The Mother was also ordered to provide an address for the Father to send gifts and cards.
