The Tribunal found that despite some ties to Pakistan, Mr. Khan did not have a strong incentive to return to his home country. Furthermore, the Tribunal observed a regression in his level of study and considered the limited travel home and the length of time he had already spent in Australia. Consequently, the Tribunal was not satisfied that Mr. Khan met the genuine temporary entrant criterion.

As the primary applicant did not satisfy the criteria, the secondary applicant, his wife, could not satisfy the requirements either, as she was not a member of a family unit of a person who met the primary criteria. Accordingly, the Tribunal affirmed the decisions not to grant the Student (Temporary) (Class TU) visas to the applicants.
