CaseChat Overview and Summary
The primary legal issue before the Commission was whether the agreement provided for fair and reasonable terms and conditions of employment. This involved an assessment of whether the agreement contained provisions that met the "better off overall test" as required by section 234 of the Fair Work Act. The unions argued that certain provisions, including those related to wages, hours of work, and penalties for breaches, did not meet this standard. The Commission needed to consider these submissions and weigh them against the overall fairness and reasonableness of the agreement.
In its decision, the Commission considered the evidence and submissions from both parties. It examined the proposed terms and conditions, including wages and penalties, and compared them against the Fair Work Act's requirements and prevailing industry standards. The Commission determined that while some provisions raised legitimate concerns, the overall agreement provided fair and reasonable terms and conditions of employment. The Commission emphasised the importance of the agreement in providing clarity and certainty to both employers and employees within the NSW civil construction sector. It approved the agreement, noting that it met the statutory requirements for approval.
The final orders of the Commission approved the Kenny Constructions (Aust) Pty Ltd NSW Civil Construction Enterprise Agreement 2020, subject to certain conditions that the company must comply with. The unions were directed to give notice of the approved agreement to their members, and the agreement was to be registered with the Fair Work Commission. The decision provides clarity and sets a precedent for future enterprise agreements in the NSW civil construction sector.
