CaseChat Overview and Summary
The legal issues before the Commission included whether the changes in the employment landscape justified the termination of the agreement, and whether the parties' inability to reach a new agreement warranted termination. Additionally, the Commission had to consider whether the termination of the agreement would have a detrimental impact on the employees covered by the agreement. The Commission assessed the evidence presented by both parties and examined the broader context of the changes in the employment landscape.
In its decision, the Fair Work Commission found that the changes in the employment landscape, including the introduction of the modern award, warranted the termination of the agreement. The Commission noted that the parties had been unable to reach a new agreement, which further supported the termination. The Commission concluded that terminating the agreement would not have a detrimental impact on the employees, as they would be covered by the modern award. Accordingly, the Commission granted the application for termination of the agreement. The termination will take effect on the date specified in the decision, and the modern award will apply to the employees from that date.
