CaseChat Overview and Summary
In the matter of *Keen & Baird*, Mr Keen sought a review of a Senior Registrar's decision concerning his time with his children, X and Y. The dispute centred on the father's request for increased unsupervised time, which was opposed by the mother who alleged sexual abuse of a child by the father. Both parents had a history of drug abuse, and the existing changeover arrangements were causing stress to the children.
The court was required to determine the appropriate parenting orders, specifically addressing the level of parental responsibility, the extent of the father's time with the children, and the arrangements for supervision and changeovers, in light of the serious allegations and the parties' histories.
Rees J determined that the mother should have sole parental responsibility for the children. The father was granted supervised time with the children each Sunday from 9 am to 5 pm, with supervision to be provided by Ms B. The court ordered that all changeovers were to occur at a designated contact centre, with specific directions for both parents and the supervisor to facilitate these arrangements. The father was also ordered to pay the costs of the contact centre. Furthermore, both parents were restrained from discussing the proceedings or allegations with the children, questioning them about the allegations, or denigrating the other parent in their presence.
