Kedis and Kedis

In the matter of *Kedis and Kedis*, Judge Hartnett considered a dispute between a husband and wife concerning the distribution of funds held in trust by the wife's solicitors. The wife sought reimbursement for legal costs and further costs, while the husband sought the release of funds held in trust.

The court was required to determine the appropriate allocation of the funds held in trust, specifically addressing the wife's claims for reimbursement of legal costs and the payment of reserved costs, as well as the husband's entitlement to the remaining funds. The court also had to consider an amount to be held in trust pending further applications by the wife regarding taxation and payment of costs.

Judge Hartnett ordered that $20,000 be paid from the trust monies to the wife, comprising $10,000 for reimbursement of legal costs and $10,000 for reserved costs and the costs of the present proceeding. The wife was also ordered to pay the husband $500 for repairs to the former matrimonial home, to be offset against the monies payable to her. The remaining trust monies were to be paid to the husband, with the exception of $5,000 to be held pending any application by the wife within 28 days for taxation and/or payment of costs by the husband.
