CaseChat Overview and Summary

The Administrative Appeals Tribunal reviewed a decision concerning Mrs Kaur's application for a Skilled (Provisional) (Class VC) visa, Subclass 485 (Temporary Graduate). The central dispute revolved around whether Mrs Kaur had satisfied Public Interest Criterion (PIC) 4005, a requirement for the visa grant.

The Tribunal was tasked with determining if Mrs Kaur had met the health assessment requirements stipulated by PIC 4005(1)(aa)(i) of Schedule 4 to the Migration Regulations 1994. This criterion mandates that applicants in specified classes undergo particular medical assessments unless a Medical Officer of the Commonwealth directs otherwise. The specific requirements for Mrs Kaur, an Indian national intending to work as a Nurse for a stay of six months or more, included a medical examination, chest x-ray, HIV test, Hepatitis B test, and Hepatitis C test, as outlined in IMMI 15/144.

The Tribunal found that Mrs Kaur had provided evidence of attending a Sonic HealthPlus facility where she underwent the specified medical examinations on 6 November 2017. Further, an independent search of the Department's electronic records confirmed that her health assessment was finalised as "Recommend Cleared" on 9 November 2017. The Tribunal interpreted "Recommend Cleared" according to the Department's Procedures Advice Manual as indicating no health concerns were identified and that the clearance would be valid for subsequent temporary visas. Consequently, the Tribunal was satisfied that Mrs Kaur had met the health assessment requirements of PIC 4005(1)(aa).

Given this finding, the Tribunal remitted the application for a Skilled (Provisional) (Class VC) visa, Subclass 485, back to the Minister for reconsideration of the remaining visa criteria. The Tribunal directed that Mrs Kaur had met PIC 4005(1) for the purposes of clause 485.216 of Schedule 2 to the Regulations.
