CaseChat Overview and Summary

This matter concerned an appeal by Ms Kaur against the decision of the Tribunal to affirm the refusal of her Partner (Residence) (Class BS) visa. The primary issue was whether Ms Kaur and her sponsor were in a spousal relationship as defined by section 5F of the Migration Act 1958 (Cth). The Tribunal was satisfied that the parties were validly married, having provided a marriage certificate.

The Tribunal was required to determine if the parties met the remaining criteria for a spousal relationship under section 5F(2) of the Act, which includes a mutual commitment to a shared life to the exclusion of others, and that the relationship is genuine and continuing, and that the couple live together or do not live separately and apart on a permanent basis. In making this determination, the Tribunal had regard to all circumstances of the relationship, including financial and social aspects, the nature of the household, and the commitment to each other, as outlined in regulation 1.15A(3) of the Migration Regulations 1994.

The Tribunal found that while the parties were validly married, the evidence presented regarding the financial aspects of their relationship was limited. Ms Kaur provided only receipts for rental payments made in late 2017 and early 2018, which did not demonstrate a significant pooling of financial resources or joint financial commitments. The Tribunal noted the absence of documentation concerning joint ownership of assets, joint liabilities, or the basis of sharing day-to-day household expenses. Consequently, the Tribunal concluded that the applicant had not satisfied the criteria for the grant of the visa.
