The Administrative Appeals Tribunal (AAT) considered the application of Ms Kaur for review of a decision to refuse her Student (Temporary) (Class TU) visa (subclass 500). The core of the dispute concerned the timeliness of Ms Kaur's application for review.

The Tribunal was required to determine whether it had jurisdiction to hear Ms Kaur's application for review, given that the application was lodged with the Tribunal after the prescribed time limit.

As this date was outside the timeframe stipulated by the relevant legislation for making an application for review, the Tribunal concluded that it lacked jurisdiction to consider the matter. Consequently, the Tribunal made no order in relation to the merits of the visa refusal.
