CaseChat Overview and Summary

This matter concerned an appeal to the Administrative Appeals Tribunal by Mrs Kaur against the refusal of her application for a Skilled Regional Sponsored (Provisional) visa (Subclass 489). The primary applicant was Mrs Kaur, with her husband, Mr Manjit Singh, and their two children listed as secondary applicants. The delegate refused the visa application because they were not satisfied as to the identity of Mr Manjit Singh, which led to the refusal of the application for Mrs Kaur and the children as they were not considered members of the family unit of a person who satisfied the visa requirements.

The Tribunal was required to determine whether Mr Manjit Singh's identity was sufficiently established for the purposes of the visa application, particularly in light of conflicting information provided by him. Specifically, the Tribunal had to consider whether Mr Singh had been known by any other name, and if so, the implications of this for the visa application, including whether he had provided a false identity or misleading information, and whether this satisfied the criteria under Public Interest Criterion 4020(2)(a).

The Tribunal noted that Mr Singh had initially stated he had never been known by any other name on his visa application and a Form 80. However, he later provided a statement admitting to having previously used the name Amarjeet Singh and having a different original date of birth. He also admitted to previous illegal travel to another country and obtaining a new identity, including a new passport with a new name and date of birth, to facilitate further travel. While a birth certificate in the name of Amarjit Singh with the original date of birth was provided, the Tribunal found the evidence regarding the timing and reasons for the name change, including claims of astrological significance or safety concerns, to be inconsistent and lacking in sufficient corroboration. The Tribunal concluded that the delegate's decision to not be satisfied as to Mr Singh's identity was justified.

Consequently, the Tribunal affirmed the delegate's decision to refuse the visa application.
