This matter concerned an appeal by Ms Katte against a decision of the Social Security Appeals Tribunal regarding an overpayment of her aged pension. The dispute centred on whether Ms Katte had been overpaid the aged pension in the amount of $32,978.75 between 20 January 2012 and 20 November 2015, and if so, whether there were grounds to write off or waive all or part of this debt. The case was heard by Dr L Bygrave, Member, of the Administrative Appeals Tribunal.

The Tribunal was required to determine two primary legal issues. Firstly, whether Ms Katte had indeed received an overpayment of her aged pension in the specified amount and period. Secondly, if an overpayment was established, the Tribunal had to consider whether any grounds existed for writing off or waiving the debt, either in whole or in part, due to administrative error or special circumstances.

The Tribunal's reasoning focused on the legislative framework governing the calculation of aged pension rates, which are influenced by a person's income and assets as defined by the Social Security Act 1991 (Cth). It was noted that Ms Katte had received periodic notices from Centrelink, as required by the Social Security (Administration) Act 1999 (Cth), informing her of her obligation to report changes in her circumstances within 14 days. While Ms Katte asserted she had provided updated financial information to Centrelink, the Tribunal found no record of these transactions within Centrelink's system. Ultimately, the Tribunal concluded that Ms Katte's situation did not present "special circumstances" that would justify waiving the debt, finding no unfairness or injustice beyond the ordinary case.

Consequently, the Tribunal set aside the previous decision and substituted its own finding. It determined that Ms Katte had incurred a debt of $32,978.75 due to an overpayment of aged pension for the period from 20 January 2012 to 20 November 2015, with the exception of $2,019.93 which had already been waived by an Authorised Review Officer.
